Terms of sale
The website is created for the sale to private consumers of wines in compliance with the Italian legislation on distance contracts. Purchases can only be made by adults.
The sale is governed by these General Conditions as well as by the methods indicated in detail in the sections of this site called, respectively, the Privacy Clause and Delivery Methods, which must be considered an integral and substantial part of the sales contract. Therefore, the Customer is invited, before sending the order, to carefully read the conditions of sale as identified above and the information contained therein and to print or save them on other durable medium accessible to him.
Any changes or new conditions of sale will be promptly reported to the Customer, will be effective from the moment of publication on the site and will be applied only to sales concluded after publication.
The sending of the order by the Customer is valid as acceptance of the conditions of sale currently in force.
CONCLUSION OF THE CONTRACT:
The order sent by the Customer to Dianella Società Agricola a r.l. through the Internet it must be completed in all its parts and must contain the elements necessary for the identification of the Customer and the products ordered as well as the indication of the place of delivery, under penalty of nullity. Dianella Società Agricola a r.l. will send the Customer via e-mail or other form of communication a confirmation of order receipt, containing a reference to the applicable sales conditions.
AVAILABILITY OF PRODUCTS:
Dianella Società Agricola a r.l. undertakes, in accordance with the law, to promptly inform the Customer of the unavailability of the product ordered.
To guarantee an adequate service in terms of time but also to safeguard the product (e.g. breakages during transport) for shipments we rely on couriers specialized in the transport of quality wine.
Note: The latter will call you to agree on the day and time of delivery in case you have expressly requested delivery by appointment while choosing the place of destination.
In the event that the appointment is not requested and if the recipient is not available, after two attempts, the goods will go into stock, therefore the amount of the delivery and the costs of storage must be repaid.
Deliveries are always intended on the street level.
Dianella Società Agricola a r.l. delivers the product or products ordered by the Customer, under the conditions expressly indicated in the section of this site called Delivery Methods.
PRICES AND PAYMENT METHODS:
The prices of the products indicated in the various sections of this site include VAT. The prices applied are those indicated on the site at the time of the order by the Customer. The prices of the individual products are subject to change and, therefore, the prices indicated from time to time on the site, cancel and replace those previously indicated. The price of the products purchased, together with the cost of home delivery, must be paid by the Customer when ordering online, by Paypal or advance bank transfer. Purchases made on this portal are safe and guaranteed. –
Payment by advance bank transfer:
In case of payment by advance bank transfer, the order will be managed only after receiving confirmation of the credit from the bank. The communications relating to the payment and the data communicated by the customer when it is made take place on special protected lines.
– Payment by credit card:
Each payment by the customer can only be made by means of the credit cards indicated on the website www.villadianella.it. The communications relating to the payment and the data communicated by the customer when it is made take place on special protected lines.
Payment with PayPal:
By selecting the type of PayPal payment, you will be redirected to a page on the PayPal site where you will enter your e-mail address and password and make the payment.
PayPal commissions are paid by Dianella Società Agricola a r.l. and therefore included in the order summary.
Your financial data will not be shared with Dianella Società Agricola a r.l. but they will be managed directly by PayPal.
In case of cancellation of the order or non-acceptance by Dianella Società Agricola a r.l., the amount will be refunded to your PayPal account. Dianella Società Agricola a r.l. will not be responsible for delays and / or damages caused during the reimbursement phase.
In case of cancellation of the order or non-acceptance by Dianella Società Agricola in r.l., the amount will be refunded by the same means with which the order was made (Credit Card, Bank Transfer or Paypal)
The tax documentation will be issued by Dianella Società Agricola a r.l. upon delivery.
To request copies of documents (receipt, invoices, etc …) the customer can contact Dianella Società Agricola at r.l. by email at email@example.com or by phone at +39 0571 508166 remembering to ALWAYS indicate the type and number of the document for which the copy is requested.
WARRANTIES AND LIABILITY:
Dianella Società Agricola a r.l., within the limits of availability as disciplined above, guarantees that products equal to those indicated and described on the site will be delivered. It guarantees compliance with all the rules regarding the conservation of the products until the moment of delivery in the place indicated in the order. The responsibility of the manufacturer applies to all products sold. In the case of packaged products, the manufacturer is also responsible for the truthfulness and completeness of the information on the packaging. The images on the site are provided to the customer to facilitate product recognition; due to changes in the packaging by the manufacturer, the photos may not exactly reflect the appearance of the product delivered.
Once the order and payment have been received by the Customer, Dianella Società Agricola a r.l. agree the pickup with the shipping company. Once the products have been collected, the goods are delivered in Europe Countries in 2 weeks, in USA 4 weeks, rest of the world 4 to 5 weeks.
– It’s possible to deliver no more then 12 bottles in Japan, Hong Kong and Australia.
– For orders to Canada no more than 24 bottles can be shipped. Clients must provide full information and passport photo, invoice is issued by Dianella Societa Agricola a r.l. with the full value of the products and duties requested by Canadian Customs Authorities must be paid in terms of 50% to 100% of the value of the invoice by the client before the clearance and delivery. Dianella Società Agricola a.r.l. has no responsibility for unpaid duties and consequently for the delay or non delivery of the order. Deliveries are always intended on the street level.It is possible to request delivery by appointment with an additional cost of € 7.00.
If an appointment is not requested, the courier will attempt to deliver the goods twice, after which it will go into storage and will then be returned to the sender: the Customer will therefore have to pay the additional costs of storage and return in full.
INFORMATION ON ORDER STATUS AND SHIPMENTS:
For each shipment, the customer has the right to request by e-mail at firstname.lastname@example.org the tracking number relating to the shipment of his order through which he can check on the website of the courier / carrier used, or through the call -center of the same, the shipping status of your order.
The cost of transport will be calculated by the system based on the number of items ordered.
FREE: for orders over 12 wine bottles or multiple of 6, delivery on European Countries and USA territory is honored by Dianella Società Agricola a r.l ..

AT THE TIME OF DELIVERY CHECK THAT:
- the package is intact, not damaged or wet
- the quantities correspond to those you ordered.
In the event that you detect a damage or a deficiency, we suggest you accept the delivery subject to inspection and contact us immediately at email@example.com: in this way you will have the opportunity to calmly check the compliance of the order and Dianella Società Agricola a rl will have the opportunity to retaliate on the courier in case of anomalies.
For oil cans, denting in the can which does not cause liquid to escape from inside cannot be considered as refundable damage.
CANCEL OR MODIFY AN ORDER:
To modify or cancel an order already submitted, it is necessary to promptly contact Dianella Società Agricola at r.l. by email at firstname.lastname@example.org or by phone at +39 0571 508166 ALWAYS indicating the reference order number.
DISPUTES AND APPLICABLE LAW:
Civil disputes relating to the application, execution and interpretation of the distance selling contract are subject to Italian jurisdiction and the Court of Florence will have jurisdiction. The contracts concluded at a distance with Dianella Società Agricola a r.l. are governed by Italian law and, although not expressly provided for, the relevant legal provisions apply.
